PRICING

We reserve the right to claim the tolerance in height for slower growing trees, as set forth in ANLA Standard Guide and charge according to caliper.  Prices herein are for the trade only and cancels all previous prices quoted by Don Yancy & Sons Nursery.  All prices are F.O.B. McMinnville, Tenn.  Prices are based on present market conditions and are subject to change without notice.


TERMS OF PAYMENT

To those who have established credit with us, payment is net 30 days.  If you do not have an established account, a down payment of 50% is required on each order with the balance due 15 days prior to shipment.  All accounts over 30 days are subject to a service charge of 1½% per month, plus cost of collection.


CLAIMS

No claims will be considered unless made in writing within ten (10) days after the receipt of plants.


SHIPPING
 We request the buyer give instructions regarding the way the order is to be shipped. If instructions are not given, we will use our judgment as to the best way and means to ship the order. The customer is responsible for unloading the truck. Freight payment is due upon delivery unless other arrangements have been made.

CONDITION OF SALES
 Every effort is made to keep our stock true to name and up to grade. We hold ourselves in readiness to make satisfactory adjustment for anything that proves to be otherwise. It is mutually agreed that we will not be responsible for more than the purchase price. Buyers agree that any dispute arising out of the sale of these goods shall be litigated in the Chancery Court of Warren County, TN and that the State of Tennessee shall be the only forum for any and all litigation which may arise from the sale of goods by the seller. Either party may not prevailing in such action shall be liable to the prevailing party for reasonable attorney fees.

SUMMER DIGGING
May 15th through September 30th we reserve the right to add 20% to our listed prices. 


INSPECTION
 Our nursery stock has been inspected by the Tennessee Department of Agriculture.

LOCATION
 We are located three miles east of McMinnville just off Highway 127 North on Old Shellsford Road near the Shellsford Baptist Church.
