Terms of payment

• To those who have established credit with us, payment is Net 30 days.  If you do not have an established account, a cash down payment of 50% is required with your order and balance due 15 days prior to shipment.  All accounts over 30 days are subject to a service charge of 1 1/2% per month plus cost of collection.  Prices herein are for the trade only and cancel all previous prices by us.  All prices are F.O.B. McMinnville TN.  Prices are based on present market conditions and are subject to change without notice.

Claims

• No claims will be considered unless made in writing within ten days after receipt of plants.

Shipping

• We request our buyers to give instructions regarding the way you want your order shipped.  If you do not, we will use our best judgement as to the best way.

Condition of Sales

• Every effort is made to keep our stock true to name and well up to grade.  We hold ourselves in readiness to make satisfactory adjustment for anything that proves to be otherwise.  It is mutually agreed that we will not be responsible for more than the original purchase price.  Buyers agree that any dispute arising out of the sale of these goods shall be litigated in the Chancery Court of Warren County, Tennessee, and that the State of Tennessee shall be the only forum for any and all litigation which may arise from the sale of goods by the seller.  Either party not prevailing in such action shall be liable to the prevailing party for reasonable attorny fees.

Inspection

• Our nursery stock has been inspected by the Tennessee Department of Agriculture.
